  2. Referral benefits will be credited within two weeks of the successful conversion of the referred project.
  3. All referral payouts will be processed exclusively through bank account transfers.
  4. A successful conversion is defined as the payment of a booking amount equivalent to at least 5% of the total project value.
  5. There is no limit to the number of referrals an individual can make within a calendar year.
  6. This referral program is applicable only in cities where Homfix operates.
  7. Homfix reserves the right to modify, amend, suspend, or withdraw this offer at any time without prior notice.
  8. Homfix retains the sole authority to interpret the terms of this offer and resolve any ambiguities or disputes arising from its implementation.
  9. Referral benefits, cashback offers, discounts, or promotional schemes cannot be combined with any other offer unless explicitly stated otherwise.

By accessing or using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions. If you do not agree with any part of these Terms, you should refrain from accessing the Platform or using the Services.

1. Services

  • Homfix serves as a platform that connects customers with qualified service providers ("SPs"). We assist customers in identifying and selecting service providers based on their specific requirements and preferences.
  • Homfix acts as a facilitator between customers and service providers, supporting the successful execution of projects as per the agreement entered into between the customer and the SP. Upon execution of the contract and commencement of the project, Homfix will provide project monitoring and progress-tracking services throughout various stages of development.
  • Construction materials supplied by Homfix are available exclusively to registered business entities (B2B).
  • Individual customers (B2C) and end consumers are not eligible to purchase construction materials through Homfix Building Materials Supply Division.
  • The Supply Chain Management (SCM) team operates according to predefined timelines for the procurement and delivery of specific material categories.
  • Homfix will issue an invoice directly to the registered business entity within 48 hours of material delivery.
  • Homfix may share customer leads seeking assistance with plot development projects with approved plot-to-plot developers for a predetermined commission fee. Homfix shall not participate in or influence any negotiations related to the purchase price or terms of the land transaction.
  • Homfix provides digital marketing and promotional services to its client partners for a fixed fee. Homfix shall not be involved in negotiating, determining, or influencing the pricing of any property or real estate transaction.
  • Package pricing is determined based on the total built-up area and the number of floors included in the project.

Accessing And Using Our Site And Services

By creating an account and using the Services, you represent and warrant that all information provided by you is accurate, complete, and up to date. You agree to promptly update such information whenever any changes occur to ensure its continued accuracy. You further acknowledge that notices, communications, and updates may be sent to the email address associated with your account, and you are responsible for maintaining a valid and active email address for receiving such communications.

Restrictions

You agree that neither you nor any third party acting on your behalf shall:

  • Modify, copy, reproduce, distribute, or create derivative works from the Services, in whole or in part;
  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, structure, or underlying technology of the Services;
  • Rent, lease, sublicense, lend, transfer, or provide access to the Services to any third party without prior authorization;
  • Remove, alter, or obscure any proprietary notices, trademarks, copyrights, or labels displayed on the Services;

You further agree to:

  • Ensure that all users accessing the Services through your account comply with these Terms;
  • Take reasonable measures to prevent unauthorized access to or misuse of the Services;
  • Use the Services strictly in accordance with applicable laws, governmental regulations, and any usage guidelines provided by Homfix; and
  • In relation to the procurement or supply of building materials, confirm and represent that you are a legally compliant business entity operating in accordance with applicable laws and not acting in an individual capacity.

Charges and Fees

You acknowledge and agree that the use of services provided by a Service Provider (“SP”) may result in charges payable by you for the products and/or services rendered by such SP (“SP Charges”). Similarly, the use of services provided directly by Homfix may result in charges payable by you (“Homfix Charges”). Collectively, SP Charges and Homfix Charges shall be referred to as “Charges.”

All applicable Charges, including any cancellation fees or related costs, shall be communicated to you before the relevant products or services are provided. You are responsible for reviewing and confirming the applicable Charges each time you request any product or service. Taxes, duties, or other statutory levies shall be charged in addition to the Charges wherever required under applicable law.

Payments

All payments for Charges become due and payable immediately upon the commencement or provision of the applicable products or services, unless otherwise agreed in writing. Payments made are final and shall be non-refundable except where expressly determined by Homfix or required under applicable law.

You acknowledge that Homfix acts solely as a facilitator for payments made to Service Providers. Any purchase of products or services from an SP constitutes a direct transaction between you and the respective SP. Homfix shall not be deemed a party to such transactions and shall not assume responsibility for the performance, quality, or delivery of products or services provided by any SP.

3. Provision Of Services

As part of the Services, Homfix provides its standard technical support to registered users. Homfix operates a digital platform that enables Service Providers ("SPs") and End Customers to connect, communicate, and facilitate the provision of services and related payments in accordance with the terms agreed upon between the SP and the End Customer.

Homfix acts solely as an intermediary platform and shall not be deemed a principal, agent, partner, employer, or representative of either the End Customer or the Service Provider. Consequently, Homfix shall not be responsible or liable for any acts, omissions, disputes, transactions, agreements, or obligations arising between users of the Platform.

Users are strictly prohibited from uploading, posting, transmitting, or sharing any content that is unlawful, defamatory, discriminatory, offensive, obscene, indecent, misleading, or otherwise objectionable. Homfix reserves the right, at its sole discretion and without prior notice, to remove such content and suspend or terminate the relevant user's account if it determines that the user has violated these requirements.

5. Account Information

  • Homfix may record and maintain information relating to transactions with customers on the Platform, including details of goods or services provided, transaction values, amounts paid or outstanding, and other related commercial information (collectively referred to as “Transaction Information”). Such information may be exchanged between Service Providers (“SPs”) and customers through telephone calls, SMS, WhatsApp messages, emails, or any other electronic communication channels based on the contact information provided on the Platform.
  • Before creating or uploading the first Transaction Information relating to a customer, Homfix shall notify the customer about the use of the Platform for recording and managing such Transaction Information, including information relating to future transactions, and shall obtain the customer’s express consent for the following:
  • Creation of a customer profile on the Platform, which may require the collection and sharing of the customer’s contact details, including phone number, with Homfix;
  • Sharing of Transaction Information with Homfix and selected third parties for the purpose of enhancing, improving, and facilitating the Services;
  • Receiving communications from Homfix regarding:
  • transaction-related information recorded on the Platform;
  • payment requests and reminders;
  • updates regarding Homfix and its Services;
  • promotional offers, discounts, and services from Homfix and its business partners; and any other matters connected with the Services.
  • If a customer declines to provide consent or subsequently withdraws such consent, the SP shall immediately discontinue the use of the Services in relation to that customer and cease recording any further Transaction Information through the Platform.

User Responsibilities

  • The User represents and warrants that all information provided in connection with the Services is accurate, complete, true, and up to date as of the date of acceptance of these Terms and throughout the period of use of the Services. The User shall promptly notify Homfix of any changes to such information. Homfix shall not be liable for any loss or damage arising from inaccurate, incomplete, misleading, or outdated information provided by the User, or from the User's failure to disclose any material fact.
  • The User shall be solely responsible for complying with all applicable laws, regulations, and statutory requirements and shall bear all liability arising from any failure to do so.
  • The User agrees to provide all reasonable assistance and cooperation to Homfix in defending any claim, action, or proceeding arising from the User's breach of these Terms.
  • While Homfix may maintain routine backups of Transaction Information, the User is solely responsible for independently saving, backing up, and archiving such information on a regular basis.
  • The User shall use the Services only as expressly permitted under these Terms and shall not:
  • Infringe the intellectual property or proprietary rights of any person or entity, including copyrights, trademarks, patents, or trade secrets;
  • Copy, reproduce, distribute, modify, publish, transmit, display, create derivative works from, license, or otherwise exploit the Services except as expressly permitted herein;
  • Upload, transmit, or distribute any viruses, malware, worms, spyware, Trojan horses, or other harmful code designed to disrupt, damage, or interfere with any software, hardware, or network;
  • Use any robot, spider, scraper, automated tool, or manual process to monitor, copy, or extract content from the Platform or Services;
  • Systematically retrieve data or content from the Platform to create or compile a collection, database, directory, or similar resource;
  • Use the Services for any unlawful, fraudulent, deceptive, harmful, or unauthorized purpose
  • Violate any applicable law, regulation, or third-party right.

7. Intellectual Property Rights

  • All rights, title, and interest in and to the Platform and Services, including all associated intellectual property rights, are owned by or licensed to Homfix. Subject to the User's compliance with these Terms, Homfix grants the User a limited, non-exclusive, non-transferable, non-sublicensable, revocable, and royalty-free license to access and use the Platform and Services solely in accordance with these Terms.
  • Users may voluntarily provide suggestions, comments, ideas, enhancement requests, or bug reports relating to the Platform or Services ("Feedback"). Homfix may freely use, modify, reproduce, disclose, publish, distribute, and otherwise exploit such Feedback without compensation, acknowledgment, or restriction.
  • Except as expressly stated in these Terms, nothing herein grants any license or right in respect of Homfix's intellectual property or the intellectual property rights of any third party.

8. Term and Termination

  • These Terms shall remain in force until terminated in accordance with their provisions.
  • Homfix may suspend or terminate the User's access to the Services immediately and without prior notice if the User breaches any provision of these Terms.
  • Upon termination:
  • Access to the Services shall cease;
  • The User shall no longer be entitled to use any features of the Services
  • These Terms shall terminate except for provisions that by their nature are intended to survive termination.
  • All outstanding amounts owed by the User in connection with the Services shall become immediately due and payable upon termination.

9. Disclaimers and Warranties

  • The User accesses and uses the Services entirely at their own risk.
  • Homfix does not endorse, recommend, guarantee, or warrant any Service Provider ("SP") listed on the Platform. Although Homfix may conduct certain verification processes, it does not represent or warrant that any SP is licensed, qualified, insured, bonded, competent, or capable of performing any particular service.
  • References to products, services, trademarks, manufacturers, suppliers, or other information do not constitute endorsement, sponsorship, or recommendation by Homfix. Any estimates provided through the Services are indicative only and should not be construed as guarantees of actual project costs.
  • Any transaction, communication, agreement, payment, or interaction between a User and a third party, including any SP, is solely between those parties. Homfix shall not be responsible for any loss, damage, dispute, claim, or liability arising from such interactions.
  • Homfix acts solely as a technology platform facilitating connections between Users and SPs and is not a party to any agreement entered into between them.
  • To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis without warranties of any kind.
  • Homfix expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, compatibility, and uninterrupted availability.
  • The User assumes full responsibility for any consequences resulting from the use of the Services and agrees that Homfix shall not be liable for any such consequences.

10. Indemnification

The User agrees to indemnify, defend, and hold harmless Homfix, its affiliates, subsidiaries, directors, officers, employees, agents, licensors, successors, and assigns from and against any claims, actions, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • The User's use of the Services
  • Any breach of these Terms;
  • Violation of applicable law
  • Any use of the User's account by a third party.

11. Limitation of Liability

To the fullest extent permitted by law, neither Homfix nor any of its affiliates, subsidiaries, parent companies, officers, directors, employees, or agents shall be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenue, goodwill, business opportunities, or data arising out of or relating to the Services or these Terms.

The User hereby releases and discharges Homfix and its related entities from all claims and liabilities arising from the use of the Services.

12. Consent to Use Data

  • The User consents to Homfix collecting, processing, storing, and using information in accordance with its Privacy Policy.
  • Homfix may use data relating to the User's use of the Services for analytics, research, statistical analysis, service improvement, and operational purposes.
  • Homfix may disclose User information where required by applicable law, court order, regulatory authority, governmental body, or law enforcement agency.

13. Modification of Services

Homfix reserves the right, at any time and without liability, to modify, suspend, discontinue, or replace any aspect of the Services, either temporarily or permanently, with or without notice.

14. Compliance with Laws

The User agrees to comply with all applicable central, state, and local laws and regulations in connection with the use of the Services.

If Homfix reasonably believes that the User is violating any applicable law or engaging in conduct that may adversely affect consumers, businesses, or the Platform, Homfix may suspend or terminate the User's access to the Services immediately.

15. Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of India. Subject to Clause 15(b), the courts located in Bengaluru, Karnataka, shall have exclusive jurisdiction over disputes arising from these Terms.
  • Any dispute, controversy, or claim arising out of or relating to these Terms shall be referred to and finally resolved by arbitration in Bengaluru in accordance with the Arbitration and Conciliation Act, 1996.
  • The arbitration shall be conducted by a sole arbitrator appointed by Homfix, and the proceedings shall be conducted in English.
  • The parties shall maintain the confidentiality of all arbitration proceedings and awards except where disclosure is required by law.
  • Each party shall bear its own costs and expenses relating to the arbitration.

16. Express Delivery Program

The Express Delivery Program is subject to project eligibility criteria, location availability, documentation verification, payment compliance, site conditions, and other requirements specified by Homfix. Homfix reserves the right to amend, suspend, or withdraw the program at any time without prior notice.

17. Miscellaneous

  • Homfix may amend these Terms from time to time by notifying Users. Continued use of the Services following such notification shall constitute acceptance of the revised Terms.
  • If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  • The User may not assign or transfer any rights or obligations under these Terms without Homfix's prior written consent. Homfix may assign its rights and obligations without restriction.
  • All legal notices to Homfix shall be sent to care@homfix.co.in
  • No third party shall have any rights to enforce these Terms.
  • Homfix shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including natural disasters, war, terrorism, civil unrest, labour disputes, governmental actions, or internet disruptions.
  • These Terms, together with the Privacy Policy and any other applicable policies, constitute the entire agreement between the User and Homfix.

  • If Homfix initiates legal proceedings due to the User's breach of these Terms, Homfix shall be entitled to recover all reasonable legal fees and associated costs.
  • Users may be required to create and maintain an account and shall be responsible for safeguarding login credentials and maintaining account security.
  • The User agrees to maintain confidentiality of non-public information obtained through the Services and authorizes Homfix to communicate through email, phone calls, SMS, WhatsApp, and other communication channels regarding services, promotions, and related activities, subject to applicable law.
  • Any warranty relating to construction services, including structural warranties, shall be provided solely by the relevant contractor under the applicable construction agreement. Homfix does not provide any warranty in relation to construction quality, workmanship, structural defects, or related matters unless expressly agreed in writing.
